1. Acceptance of Terms
By accessing or using Mimicking ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Mimicking provides AI-powered image generation tools that transform reference images to match your brand's visual identity ("Brand DNA"). The Service includes free and paid tiers.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.
4. Acceptable Use
You agree not to: upload illegal, harmful, or infringing content; use the Service to generate deceptive or misleading advertising; attempt to reverse-engineer the AI models; resell or redistribute generated images as a competing service; use automated systems to access the Service beyond normal use.
5. Intellectual Property
You retain ownership of images you upload. Images generated using paid credits are licensed to you for commercial use in your advertising campaigns. The Mimicking platform, AI models, brand DNA technology, and all related intellectual property remain the property of Mimicking.
6. Credits and Payments
Credits are purchased through our payment partner (Airwallex). 1 credit = 1 image generation. Credits do not expire. Unused credits are refundable within 30 days of purchase. Mimicking reserves the right to change pricing with 30 days notice.
7. Limitation of Liability
The Service is provided "as is" without warranties of any kind. Mimicking shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for credits in the preceding 12 months.
8. Termination
Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. Unused credit refunds are subject to Section 6.
9. Changes to Terms
We may update these terms from time to time. Continued use of the Service constitutes acceptance of the updated terms. Material changes will be communicated via email.
10. Governing Law
These terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be resolved in the courts of Hong Kong.
